France Introduces Profit Sharing Mandate for Smaller Employers

On 29 November 2023, the French government passed the Profit-Sharing Act requiring companies with 11 to 49 employees to implement a profit-sharing scheme effective from 1 January 2025. This program is set to run as a five-year trial and will then be reassessed by the government to determine if the profit-sharing obligation for these smaller employers will become permanent and in what format.

France Expands Paid Leave Entitlement

The labor division of the French High Court (Cour de Cassation) issued decisions enabling employees who are absent from work due to sick leave to accrue paid time off during their leave. The revised method of paid leave accrual came into immediate effect on 13 September 2023 for all companies.

France Enhances Leave Entitlements for Working Parents of Children Suffering from a Disability or a Serious Health Condition

The French government recently passed amendments to the Labor Code increasing government-paid bereavement leave following the passing of an employee’s child, as well as government-paid leave that may be taken following the diagnosis of a child’s disability or serious health condition.
The amendments entered into effect on 19 July 2023.

France to reform its pension system

The French government recently introduced legislation aiming to reform the country’s pension system by gradually increasing the minimum retirement age from 62 to 64, as well as the number of years of insured employment needed to be eligible for a full pension from 42 to 43 years.  

To speed the passage of the controversial reform, the French government used its constitutional power to bypass the parliament vote. The reform is expected to enter into effect once its compliance with the French constitution is confirmed by May 2023.
